The ongoing battle patent battle between Apple and Samsung won’t see any conclusion in the foreseeable future, as Samsung has added the iPhone 5 to the list of phones that violates its patents. This decision if it goes Samsung’s way could stop the sale of the iPhone 5 in the US which has seen a record number of pre orders since its announcement. Samsung has confirmed that the iPhone 5 will add to the number of phones being pursued.

The information currently available indicates that iPhone 5 like most of the prior iPhone versions will violate the asserted patents. Samsung is expected to push things a little faster as the Korean based vendor claims that it will file a motion to amend its prior infringement contentions. This will allow Samsung to get a better opportunity to analyze the iPhone 5. The two key players in the smartphone industry have locked horns in several lawsuits, with Apple securing a landslide victory in the latest one. Different countries have borne witness to such lawsuits that have gone either way. These lawsuits have seen a drastic increase in number in the recent past, and that remains unlikely to change.

Samsung has already taken its case to consumers, as the Korean conglomerate released an advertisement criticizing the iPhone 5 and those queuing up for the release of Apple’s products. Analysts are projecting another record quarter of sales for the iPhone 5 with reports suggesting that the latest phone will surpass its predecessor’s sales. Samsung is clearly going on the offensive against the iPhone 5 with an ad attack. The advertisement merely mocks those in wait for the new iPhone.

Samsung seems to be popularizing the tagline “It doesn’t take a genius” with its new ad attack, taking a dig at the features of the new iPhone. Another tagline that is catching up among Samsung supporters is “the next big thing is already here”. Samsung clearly seems upset over the recent lawsuit and is striving to affect iPhone sales by negative advertising. This is not the first time that Samsung has resorted to negative campaigning, as was seen with the Galaxy S2 last year. The advertisement comes at a time when people are already set to purchase the iPhone 5 which goes on sale one 8 A.M Friday. It remains to be seen how this ad works in favour of Samsung and also what course the lawsuit takes over time.
